Taking a side on the DEATH PENALTY requires engaging with deeply held convictions about justice, human rights, and social policy. Those who support the death penalty assert that it delivers appropriate retribution, deters serious crime, and upholds public safety. In contrast, opponents maintain that capital punishment is inherently inhumane, prone to discrimination, and presents an unacceptable risk of executing innocent individuals; they also challenge its effectiveness as a deterrent. As a result, the debate compels individuals and societies to weigh the demands for justice and security against enduring ethical concerns and the value of human life.

The Case “Against” Capital Punishment: Ethical, Legal, and Social Arguments

  • Stephen F. Rohde is a former constitutional lawyer, lecturer, and political activist. He serves as the chair emeritus of the ACLU Foundation of Southern California and was the immediate past chair of Bend the Arc, a Jewish organization focused on justice.
  • He has also held the position of President of the Beverly Hills Bar Association and founded Interfaith Communities United for Justice and Peace. He was the former chair of Death Penalty Focus. Rohde currently hosts the podcast “Speaking Freely: A First Amendment Podcast with Stephen Rohde.” He is the author of American Words of Freedom and Freedom of Assembly (part of the American Rights series).
