SEN. MARK KELLY SUES PENTAGON, ACCUSES MILITARY OF SILENCING DISSENT OVER TRUMP-ERA ORDERS
Mark Kelly, a retired Navy Captain and current U.S. Senator (Democrat), argues that the Defense Department’s measures violate his First Amendment rights and the Speech or Debate Clause.
SLING NEWS: Sen. Mark Kelly (D-Ariz.) is challenging the Department of Defense and Secretary Pete Hegseth in federal court over disciplinary measures taken against him. The controversy began after a video surfaced in which Kelly, joined by fellow members of Congress, urged U.S. servicemembers to disobey unlawful orders related to anti-drug operations in the Caribbean and Pacific. In response, Secretary Hegseth issued a formal censure and launched proceedings to consider Kelly’s demotion, asserting that his actions undermined military authority.
Kelly responded by filing a civil lawsuit in the U.S. District Court for the District of Columbia. In his complaint, he alleges that the government’s actions are retaliatory, infringe on his First Amendment rights, and interfere with his constitutional responsibilities to oversee the military. The suit seeks to overturn Hegseth’s censure and halt the disciplinary proceedings.
